我国的社区矫正的发起模式主要是国家机关主导模式,但在实践层面的运作模式上并非是单一、完全吸收其他地区性的;构建我国本土化的社区矫正机构模式,需要正确看待社区矫正试点与我国现行法律框架的冲突问题,在此基础上应允许各地因地制宜,大胆实践。
The initiation model of community correction in our country is mainly dominated by state organs. However, it is not a single mode of operation at the practical level. It absorbs other regions completely. To build a model of local community correction institutions in China requires a correct view of the community correction pilot and On the basis of this, we should allow all localities to boldly practice in accordance with local conditions in light of the conflicts in our current legal framework.
