爲了明確規定工會組織在新民主主義國家政權下的法律地位與職責,使全國工人階級更好地組織起來,發揮其在新民主主義建設中應有的作用,特頒佈工會法如下:第一韋總則第一條工會是工人階級自願結合的羣衆組織。凡在中國境內一切企業、機關和學校中以工資收節爲其生活資料之全部或主要來源之體力與腦力的僱傭勞動者及無固定僱主的僱傭勞動者,均有組織工會之權。第二條工會組織原則,根據全國勞動大會通過之中華全國總工會章程之規定,應爲民主集中制。各級工會委員會,均應由會員大會或代表大會選舉產生。工會委員有根據工會章程之規定隨時撤換其所選舉之代表或委員之權利。各級工會委員會應向所代表之會員羣眾或其代表大會報告工作,並服從上級工會組織之决議或指示。第三條工會爲根據全國勞動大會及各産業工會(包括公務人員工會)之代表大會通過的章程與决議所組成之羣衆團體,有其全國獨立的、統一的組織系統,以中華全國總工會爲最高領導機關。凡工會組織成立時,均須報告中華全國總工會或其所屬之産業工會、地方工會,經審查批准,轉
