第一章总则第一条为了改革城镇国有土地使用制度,合理开发、利用、经营土地,加强土地管理,促进城市建设和经济发展,根据《中华人民共和国城镇国有土地使用权出让和转让暂行条例》(以下简称《条例》)和有关法律、法规,结合云南省实际,制定本办法。第二条云南省城镇国有土地实行有偿使用制度。土地使用权可以依法出让、转让、出租、抵押或者用于其他经济活动。第三条县级以上人民政府对本行政区域内的城镇国有土地依法行使出让权,并实行统一规划、统一征用、统一开发、统一出让、统一管理。
Chapter I General Provisions Article 1 In order to reform the system of the use of state-owned land in cities and towns, develop, use and manage land rationally, strengthen land administration and promote urban construction and economic development, according to the Provisional Regulations on the Transfer and Use of State-owned Land in the Towns of the People’s Republic of China, (Hereinafter referred to as the “Regulations”) and the relevant laws and regulations, in light of the actual situation in Yunnan Province, the development of this approach. Article 2 The state-owned land in cities and towns of Yunnan Province shall implement the system of paid use. Land use rights may be transferred, transferred, leased, mortgaged or used for other economic activities according to law. Article 3 The people’s government at or above the county level shall exercise the right of assignment according to law for the state-owned land in cities and towns within its own administrative area and implement unified planning, unified requisition, unified development, unified transfer and unified management.
