发明相对于现有技术是否显而易见是发明是否具有创造性的条件,审查发明是否具备创造性,应当审查发明是否具有突出的实质性特点,本文结合一个案例的审查过程,通过对一个技术特征是否为公知常识的认定变化,对创造性审查中如何站位本领域技术人员,正确把握现有技术给出的技术启示进行了阐述。
