民事诉前证据保全制度探析

诉前证据保全是证据保全制度的一种基本形式。目前,我国民诉法对诉前证据保全并没有加以规定,使得民事证据保全制度不够完善。本文首先对民事诉前证据保全制度的涵义和立法现状作了介绍,接着分析了该制度在司法实践中所存在的若干问题,最后对完善我国民事诉前证据保全制度提出了几点具体的建议。

Pre-litigation evidence preservation is a basic form of evidence preservation system. At present, the Civil Procedure Law in our country did not stipulate the pre-litigation evidence preservation, which made the system of civil evidence preservation imperfect. This article firstly introduces the connotation and legislative status quo of civil pre-trial evidence preservation system and then analyzes some problems existing in the judicial practice of the system. Finally, it puts forward some concrete suggestions on how to perfect our country’s civil pretrial evidence preservation system .
