审查逮捕是国家赋予检察机关的一项重要法律监督职能,是刑事诉讼中的一个重要环节,加强审查逮捕工作对于强化刑事诉讼监督、维护公平正义,保障国家法律的统一正确实施,意义重大。新刑事诉讼法对检察机关履行侦查监督职责方面进行了全面的强化,主要表现在对审查逮捕条件和程序的明确和完善、以及逮捕后羁押必要性审查制度的新规定。
The review and apprehension is an important legal supervisory function granted by the procuratorial organs. It is an important link in criminal proceedings. Strengthening the review of arrests is of great significance to strengthening the supervision of criminal proceedings, safeguarding fairness and justice, and ensuring the uniform and correct implementation of national laws. The new Criminal Procedure Law has comprehensively strengthened the procuratorial organs’ performance of their duties of investigation and supervision, which are mainly manifested in the clarification and perfection of the conditions and procedures for the examination of arrests and the new provisions on the review system for the necessity of detention after arrest.
