2007年,国务院颁布了《政府信息公开条例》,并于2008年5月1日生效实施。这标志着我国政务信息的社会公开已进入法制阶段,行政法治已向纵深发展。但有关政务信息在国家机关之间内部共享问题,我国立法却明显不足。本文根据我国政务信息共享制度立法上存在的困难与缺陷,结合国外立法情况及特点,提出我国立法上应予借鉴的方面。
In 2007, the State Council promulgated the “Regulations on the Disclosure of Government Information” and came into effect on May 1, 2008. This indicates that the social openness of our government affairs information has entered the stage of legal system and the administrative rule of law has been developed in depth. However, regarding the internal sharing of government information among state organs, our country’s legislation is obviously inadequate. According to the difficulties and flaws in the legislation of our country’s government affairs information sharing system, this article puts forward the aspects to which our country’s legislation should draw lessons from the situation and characteristics of foreign legislation.
