6月28日,美国联邦最高法院裁定,奥巴马的医疗保险改革大部分条款合乎宪法,最具争议的“强制医保”条款得以保留。在美国的联邦机构中,联邦最高法院是支持率最高的机构,高于总统的支持率,更高于国会的支持率。其原因就在于最高法院能够超越左右派的政治倾向,根据宪法作出公正的判决。最高法院作为公平的象征,如果渗入政治因素,将会损害这种公平性。最明显的是自从2000年布什诉戈尔案以来,最高法院的支持率一直在下降,因为民众认为这个判决充满政治性的考虑。
On June 28, the Supreme Court of the United States ruled that most of Obama’s medical insurance reform was constitutional and that the most controversial “mandatory health insurance” clause was retained. Among the federal agencies in the United States, the federal Supreme Court is the institution with the highest support rate, higher than the president’s support rate and higher than the congressional support rate. The reason is that the Supreme Court can go beyond the left and right political orientation and make fair judgments based on the Constitution. As a symbol of fairness, the Supreme Court will undermine this fairness if political factors are infiltrated. Most obviously, since the Bush v. Gork case of 2000, the support for the Supreme Court has been declining because the public considers the verdict full of political considerations.
