目前,中国工程招投标活动中,存在许多违法及违规行为,其主要原因在于有关工程招投标方面立法不够完善,执法力度不够,并且没有建立起比较彻底的工程招投标市场体制。因此,解决中国工程招投标活动中存在的违法及违规行为的主要途径是:尽快完善有关工程招投标方面的立法,堵塞漏洞;加强执法力度,遏制有关违法及违规行为的发生;同时积极探索新的工程招投标方式,建立完善的工程招投标市场体制。
At present, there are many illegal and irregularities in the bidding and tendering activities in China. The main reasons are that the relevant laws and regulations on bidding and tendering are not perfect and the enforcement is inadequate, and the thorough market bidding system has not been established. Therefore, the main ways to solve the illegal and irregularities existing in the bidding and tendering activities in China are as follows: improving legislation on construction bidding as soon as possible, and plugging loopholes; enforcing laws and regulations to curb the occurrence of illegal and irregularities; and actively exploring new Project bidding approach, the establishment of a sound project bidding market system.
