比较研究大陆法系、英美法系及我国台湾地区关于合同违约行为的精神损害赔偿相关法律问题,探讨我国违反旅游合同精神损害赔偿的立法与实践,建议设立违反旅游合同精神损害赔偿法律规定。
A comparative study is made on the legal issues related to the compensation for moral damage caused by contract breach in civil law system, common law system and Taiwan lawsuit in our country. The legislation and practice of China’s compensation for mental damage in breach of tourism contract are also discussed. It is suggested that a law be established to violate the spirit of damages in tourism contract.
