我国保安业发展至今已有19年历史了。19年来,行业主管部门对保安业一直实行的是行政管制、垄断经营、地区封锁政策,即使在我国加入世界贸易组织后也没有丝毫的松动。那些明显与贸易自由化、促进公平竞争等世界贸易组织基本法律原则相悖的部门保护主义规章和地方性法规,井没有得到全面清理、修改或废止。由此引发的与外商在市场准入问题上的争议已到了白热化程度。而主管部门仍在等待观望之中,希望国家以保护幼稚产业和维护国家安全为由,对这一行业继续实行部门既定的特殊贸易保护政策。同时,如果保安业一旦允许外资进入的话,也就意味着必须按照世界贸易组织主张的非歧视贸易原则,对内资进入这一领域实行国民待遇。
Security industry in our country has been 19 years old. For 19 years, the industry authorities have been implementing the administrative, monopolistic and regional blockade policies for the security industry without any loosening even after China’s accession to the World Trade Organization. Those departmental protectionist regulations and local laws and regulations that obviously contravene the basic legal principles of the World Trade Organization such as trade liberalization and promotion of fair competition have not been fully cleaned up, amended or abolished. The resulting controversy with foreign businessmen on market access has reached a white-hot level. The competent authorities are still waiting to wait and see, hoping the state to protect the infant industries and safeguarding national security as an excuse for this industry continue to implement the department’s special trade protection policies. At the same time, once foreign investment is allowed to enter the security industry, it means that domestic investment must be treated in accordance with the non-discrimination trade principle advocated by the World Trade Organization.
