第九届全国人民代表大会第四次会议通过的“十五”纲要中提出,把依法治国与以德治国结合起来,大力推进社会主义精神文明建设,满足人民群众日益增长的多方面的精神文化需求,全面提高国民素质,增强民族凝聚力,为改革开放和现代化建设提供强大思想保证、精神动力和智力支持。党中央提出把依法治国和以德治国相结合是根据中国的国情提出的更加完善、更加合理、更加成熟的治国方略。以德治国就是要依靠人们的自律,依靠社会舆论和教育,依靠各种社会团体、社会组织的提倡和维护,依靠人的价值判断,依靠人的良知和传统习惯来治理国家,它虽然没有法律那样的强制性,但在维护广大群众的社会关系和社会秩序上起着不可忽视的作用。在社会生活中也是一种强大力量。“以德治国”有法律不可替代的作用,又是依法治国的坚实基础。它有以下几个特点:一是以德治国对于依法治国的实施,起着不可忽视的作用;二是以德治国对于依法治国中社会主义法律的不足及不完备部分起着弥补作用;三是社会主义的立法活动,必须与人们道德的要求相适应。人们道德的发展,必然影响社会主义
