《刑法》第二编第三章第一节规定了生产、销售伪劣商品罪,此节中所规定的各条犯罪行为均归属于生产、销售伪劣商品这一类犯罪,其中多个法条中所涉及的产品类型多种多样,且个案案情复杂与法律规定相对简单形成鲜明对比,进而导致该罪在司法实践中的认定带来些许困难。就目前而言,生产、销售伪劣产品类案件的犯罪侦查过程中经常会面临一些疑难问题,如犯罪对象范围如何确定以及犯罪数额如何确定等等。
The first section of Chapter III of Part II of the Criminal Law provides for the crime of producing and selling fake and shoddy commodities. All the criminal acts stipulated in this section are attributable to the crimes of producing and selling shoddy commodities. Among them, The types of products involved are diverse, and the complexity of the case is in stark contrast to the relatively simple legal provisions, which in turn leads to some difficulties in the identification of the crime in judicial practice.
