《联合国国家及其财产管辖豁免公约》的通过,对于中国处理国家及其财产管辖豁免问题具有重要意义,我国已步入由坚持绝对豁免主义转向采纳限制豁免主义的国际趋势。这既是适应我国国情的需要,也是世界政治经济发展的客观要求,在处理领土管辖权和外国豁免权之间的关系,保障人权方面都具有积极的意义。为了使国家及其财产管辖豁免问题得到更有效的解决,我国应继续在制定法律和适用法律方面不断努力。
The adoption of the UN Convention on the Jurisdictional Immunity of States and Their Property is of great significance to China’s handling of the jurisdictional immunities of its country and its property. Our country has stepped into the international trend of insisting that absolute immunity be exempt from restrictive exemptions. This is not only the need of adapting to the national conditions of our country, but also the objective requirement of world political and economic development. It has a positive meaning in handling the relations between territorial jurisdiction and foreign immunity and safeguarding human rights. In order to find a more effective solution to the issue of Jurisdictional Immunity of States and their property, our country should continue its efforts in formulating laws and applying laws.
