现代环境警察制度是我国生态法治建设的重要组成部分,是最严格环境保护制度的具体体现之一。它的建立对于维护国家环境秩序,保卫国家环境安全,震慑、遏制破坏环境与资源保护的违法犯罪行为具有不可替代的作用。以哲学视角观之,环境警察制度就其本质来说属于历史、关系和规范的范畴。我国建立环境警察制度具有客观必然性及独立性。环境警察制度的具体形式、具体内容以及能否发挥相应的作用有着强烈的主观性,即体现为环境警察制度的可选择性及可设计性。在此前提下我国环境警察制度必须找准其定位,才能切实发挥其在国家环境监管体系中无以替代的作用。
The modern environment police system is an important part of the construction of ecological law in our country and is one of the concrete manifestation of the most stringent environmental protection system. Its establishment has an irreplaceable role in safeguarding the state environmental order, defending the national environmental security, deterring and deterring criminal activities that destroy the environment and resources. From the philosophical point of view, the environmental police system by its very nature belongs to the category of history, relations and norms. The establishment of environmental police system in our country has the objective necessity and independence. Under this premise, our country’s environmental police system must find its position in order to effectively play its role in the national environmental regulatory system without any substitute.
