政府目前在公司社会责任中的责任担当无论是理论认识还是实践路径都非常欠缺。农夫山泉＂砒霜门＂事件使得政府在公司社会责任中的制度角色十分尴尬,凸显公权力是一把双刃剑。本文通过法理分析,公司社会责任的主体并非唯一,政府既是公司的利益相关者,也是公司社会责任的主体。政府首先要在现有制度框架内严格规范执法行为,监管到位不越位;其次要发挥好在企业社会责任中的导向作用;最后应提供完善公司社会责任的制度规范。
