如何协调国内产业政策与WTO法之间的矛盾是WTO新成员面临的挑战。WTO法是否真的忽视了一些新成员的发展诉求?是否应当为发展中国家“松绑”?本文以中国汽车产业政策为例,分析了中国入世后如何重新制订汽车部门的产业政策,以协调国内汽车产业政策与WTO法之间的关系。本文认为,新成员应当在现行的WTO规则和其入世具体承诺的约束之下重新制订其国内产业政策,而不赞同为发展中国家放宽WTO法的主张。
How to coordinate the contradiction between the domestic industrial policy and the WTO law is a challenge for the new WTO members. Whether the WTO law really neglected the development demands of some new members and whether it should be “loosened” to the developing countries? In this paper, taking China’s auto industry policy as an example, this paper analyzes how to re-enact the industrial policy of the auto sector after China’s accession to the WTO. Coordination of the Relationship between the Domestic Automobile Industry Policies and the WTO Law. This article argues that the new members should reformulate their domestic industrial policies under the existing WTO rules and their specific commitments under the accession to the WTO instead of agreeing to relax the WTO law for developing countries.
