抵押权是指债务人或者第三人不转移财产的占有,将该财产作为债权的担保,债务人未履行债务时,债权人依照法律规定的程序就该财产优先受偿的权利。抵押权之所以被称为“担保之王”是因为抵押人仍然享有对抵押物的占有、使用、收益、处分的权利,但是现今主要存在的争议在于抵押人是否可以不经过抵押权人的同意,自由转让抵押物。
