人民代表大会制度和民主参与共同构筑了中国现代宪政民主的基本模式。民主参与无论是作为一种政治运作方式,还是作为一种制度设计,其始终存在于现代宪政制度运行中。立法作为一种协调与平衡多元利益冲突的宪政制度,其过程是复杂而富有弹性的综合利益表达过程。地方性立法是我国立法体系中不可或缺的组成部分。在现阶段构建和谐社会的进程中,地方法治化进程和地方行政的快速发展使得地方性立法对公民权益的影响日益扩大,因此完善我国地方性立法过程中民主参与机制,保障其有效运作,对于保障公民权利和社会主义法治国家建设都具有积极而现实的意义。
The system of people’s congress and democratic participation jointly set the basic model of constitutional democracy in modern China. As a kind of political operation or as a system design, democratic participation always exists in the operation of modern constitutional system. As a constitutional system that coordinates and balances the conflicts of multiple interests, the process of legislation is a complex and flexible process of expression of the general interest. Local legislation is an integral part of our legislative system. In the process of building a harmonious society at the present stage, the rapid development of the local legal system and the local administration make the influence of local legislation on civil rights and interests increasingly widened. Therefore, the democratic participation mechanism in the process of local legislation in our country is improved and its effective operation is guaranteed. The protection of civil rights and the building of a socialist country under the rule of law all have positive and realistic meanings.
