警察权的重构需要有科学的理论为支点,否则,即使建立起来,最终也会垮掉。坚持从多条进路展开对警察权的研究会得到关于警察权构建的几个基本理念,即根据本质的警察权确定警察权的核心领域、围绕警察权的核心领域确定警察权的一般行政管理领域、在行政管理领域警察权不宜过广过深介入、确保警察权的绝对权威性、确保警察优先权实现、警察权行使不宜过早过晚的理念。目前,公安机关警察权存在着作用核心领域不明、行政管理权面广且深、执法权威受到任意挑战、警察优先权没有保障、警察权侵入市民社会自治领域等问题。公安机关警察权重构应从划定警察权的核心领域、重塑警察权行使的绝对权威性、防止公安机关警察权侵入市民社会领域等方面入手。
