伴随互联网开放平台的发展,一系列著作权侵权诉讼却让平台运营商犯起了难。以北京市第二中级人民法院为例,该院2011年受理状告开放平台著作权侵权的案件为7起,2012年迅速增至20余起。当上传至开放平台的互联网商品侵犯他人著作权时,平台运营商是否应承担法律责任?有无免责的可能?互联网开放平台是IT时代的新生事物,在立法对其规范相对滞后的特定时期,如何在审判实践中调整与之相关的法律关系,既保护著作权人的利益,又不扼杀一个能带来巨大经济效益的新兴行业,对于法院无疑是个挑战。
With the development of the Internet open platform, a series of copyright infringement litigation has made the platform operators guilty of difficulties. At a specific time when its legislation is lagging behind, Adjusting the legal relationship in the trial practice not only protects the interests of the copyright owners, but also does not stifle a newly emerging industry that can bring enormous economic benefits. It undoubtedly poses a challenge to the courts.
