随着网络技术的发展,网络侵权案件不断增加,并且呈现新形式,这些新案件的出现不可避免的对原来间接侵权责任认定的规则带来冲击。本文从美国Shapiro案入手,着重分析在网络环境下替代责任的适用性以及认定标准,并结合我国的立法背景,对网络侵权案件中替代责任的认定作深入的分析。
With the development of network technology, the number of Internet infringement cases has been increasing and presenting new forms. The emergence of these new cases inevitably has an impact on the original rules of indirect liability infringement. This article starts with the Shapiro case in the United States. It focuses on the applicability of the alternative liability under the network environment and the criteria for its determination. Combined with the legislative background of our country, this article gives an in-depth analysis of the determination of alternative liability in the network infringement case.
