随着中美知识产权贸易摩擦的频频发生,中国已经成为了美国“337诉讼”的重灾区.“337诉讼”成为中美知识产权交锋的主要战场。中国企业应对“337诉讼”除了需要加强337条款理论研究外,还需要整合多方资源应诉。本文提出的解决途径主要是从中国国内出发,对策研究涉及三方主体,从政府、企业以及中介组织入手,整合有效资源提高中国企业胜诉机率。
With the frequent occurrence of trade friction between China and the United States, China has become the hardest hit by the U.S. “337 Litigation.” “337 Litigation” has become the main battlefield for the Sino-US intellectual property confrontation. Chinese enterprises to deal with “337 litigation ” In addition to the need to strengthen the Section 337 theoretical research, but also need to integrate multi-source response. The solution proposed in this paper is mainly from China. The research on countermeasures involves the tripartite subjects, starting with the government, enterprises and intermediary organizations, and integrating effective resources to improve the chances of success of Chinese enterprises.
