【裁判要旨】在刑民交叉案件中,由于权利人需要配合公安机关查明事实、侵权事实有赖刑事诉讼的生效判决确定等因素,认定公安机关要求权利人辨认涉嫌侵权货物一事,可产生两个法律后果:一是权利人得知侵权行为存在,诉讼时效期间开始起算;二是因刑事追诉程序的存在,权利人有合理理由信赖公权力的介入可使其权利获得保护,故诉讼时效随之中断。
