科学配置检察权必须遵循检察权配置的基本原则和一般规律。检察权配置的基本原则主要有:司法规律原则;古为今用,洋为中用原则;权力结构完整性原则;决策权、执行权、监督权等权力相互制约协调运行机制原则;谦抑性原则。检察权配置的一般规律:一是配置给检察机关的职权基本上是程序性权力;二是配置给检察机关的职权是在不断充实、扩大的。
