我国行政诉讼法的根本目的是保护公民、法人和其他组织的合法权益,维护和监督行政机关依法行使行政职权。行政诉讼案件的受案范围,是指人民法院对行政诉讼案件的受理,不包括对非诉执行案件和行政裁决权利人申请执行案件的受理。受案范围决定着自然人、法人或其他组织合法权益可以得到司法保障的范围和程度,影响其诉权受保护的状况,即“行政行为可诉性”或“可诉行政行为范围”。如何确定行政诉讼法受案范围是实现行政诉讼的前提条件。本文从行政诉讼的目的出发,研究抽象行政行为、内部行政行为和导致公共利益受损的行政行为等可诉性问题,对于完善我国行政诉讼立法、建设社会主义法制国家具有现实意义。
The fundamental purpose of China’s Administrative Procedure Law is to protect the lawful rights and interests of citizens, legal persons and other organizations and to maintain and supervise the executive authorities to exercise their administrative powers in accordance with the law. The scope of acceptance of administrative litigation cases refers to the acceptance of administrative litigation cases by the people’s court and does not include the acceptance of enforcement cases of non-litigation enforcement cases and administrative rights adjudication cases. The scope of the case determines whether the legal rights and interests of natural persons, legal persons or other organizations can get the scope and degree of judicial protection, which affects the status of the protection of their litigation rights, that is, “the suitability of administrative action” or “the range of actionable administrative acts” . How to Determine the Scope of Accepting Cases in Administrative Procedure Law Is a Prerequisite for Realizing Administrative Litigation. This paper, starting from the purpose of administrative litigation, investigates the suability of abstract administrative acts, internal administrative acts and administrative acts that lead to the loss of public interests, which have practical significance for perfecting the legislation of administrative proceedings and building a socialist legal system in our country.
