当前,公安机关刑事侦查活动的重心逐渐下移,基层公安派出所在刑事侦查中的作用日益凸显。但公安派出所由于人员素质相对较低、缺乏专业法律知识和缺少有效监督制约等原因产生案件早期侦查和取证方式不当等问题,甚至产生冤假错案。我国宪法第一百二十九条规定:“中华人民共和国人民检察院是国家的法律监督机关。”在当前司法体制改革日益深化的时代背景下,人民检察院在司法活动中的法律监督地位愈发重要,尤其是在刑事侦查活动中。通过分析向公安派出所派驻检察人员的原因和重要性,并提出这一制度实施过程中应当注意的相关注意事项,希望能真正发挥该制度设计的初衷,切实保护刑事诉讼当事人的合法权益,提高公安派出所刑事侦查活动效率。
At present, the center of gravity of the criminal investigation activities of the public security organs gradually moves down, and the role of grass-roots police stations in criminal investigations has become increasingly prominent. However, the public security police station has even produced unjust and false cases because of the problems of relatively low staff quality, lack of professional legal knowledge and lack of effective supervision and control. Article 129 of China’s Constitution stipulates: “The People’s Procuratorate of the People’s Republic of China is the legal supervisory organ of the state.” In the current era of deepening judicial system reform, the people’s procuratorate’s status as a legal supervisor in judicial activities is more Important, especially in criminal investigation activities. Through analyzing the reason and importance of procuratorial staffs assigned to the police station and putting forward some cautions that should be paid attention to during the implementation of this system, I hope that the original intention of the system design can be fully displayed, the legitimate rights and interests of the parties to criminal proceedings can be effectively protected, and the public security The police station criminal investigation activity efficiency.
