正确处理好审判的法律效果与社会效果的关系是人民法院的一项司法基本制度,也是实现“公正与效率”的最佳途径。文章拟从法律效果与社会效果的涵义出发,认为要正确处理好“两个效果”的关系,必须通过坚持以人为本和法律至上的原则,坚持司法独立,加强法官素质等途径,促使审判的“两个效果”的有机统一。
Correctly handling the relationship between the legal effect and the social effect of the trial is a basic judicial system of the people’s court and the best way to achieve “justice and efficiency”. The article intends to start from the implication of legal effect and social effect, and believes that to correctly handle the relationship between “two effects”, we must insist on people-oriented and law-based principle, adhere to judicial independence and strengthen the quality of judges, “Two effects ” organic unity.
