实行社区矫正制度不能回避的首要问题就是,如何界定社区及其功能。由于社区矫正制度是一个舶来品,西方国家的社区在我国社会没有一个完全能与之对应的实体。因而,在我国当前社会语境下“社区”面临诸如国家与社会关系不协调,我国市民社会发育不足,我国社会转型下的社区问题等多重困境,我们应该协调好国家与社会的关系,努力培育我国的市民社会,塑造我国社会语境下的“社区”功能,让社区矫正制度在我国得到更好的发展。
The primary problem that can not be avoided in implementing the community correction system is how to define the community and its functions. As the community correction system is an imported product, the communities in western countries do not have an entity that can completely correspond to it in our society. Therefore, under the current social context in our country, “community ” faces multiple dilemmas such as uncoordinated state-society relations, underdeveloped civil society in our country, and community problems under the social transformation of our country. We should coordinate the relations between the state and the society, We must work hard to cultivate our civil society and shape the “community” function in our social context so that the community correction system can be better developed in our country.
