在市场经济中,附赠式有奖销售是经营者为了吸引消费者购买其商品或服务而采取的一种市场营销手段,为了更好地对附赠式有奖销售行为进行法律规制,附赠式有奖销售中赠送物品的性质认定对其应如何适用法律有重要作用,本文对附赠式有奖销售中赠送物品的性质进行研究,认为赠品实质上是商品,是买卖合同的组成部分并对该观点进行论证,在此基础上进一步对赠品的产品责任进行分析,并对赠品的产品责任认定的法律完善提出建议。
