国有国法,家有家规,法治社会下,社会的进步使人们法律意识逐渐增强,法律是维护自身权益的武器;在企业中,法律意识则显得更加重要,制定一套行之有效的内部规章制度是企业发展的前提。这个制度一经制定就成为了企业内部的“法律”。员工行为是否得到规范,利益能是否受到保障,在一定程度上决定了是企业发展的健康环境。法律与企业的规章制度有着的天然适应性,制度本身既要合理又要合法,才能被员工接受,遵守,执行,否则就是一纸空谈。本文从企业内部规章制度的制定程序、制定内容、执行情况、稳定性和灵活性等方面,结合《劳动法》、《劳动合同法》分析了法律法规在各个环节的主导作用。
