我国《劳动法》第三条规定:劳动者享有平等就业和选择职业的权利。第十二条规定:劳动者就业不因民族、性别……不同而受歧视。在我国人才市场与世界接轨的今天,还不同程度地存在着性别歧视、容貌歧视、年龄歧视等等形形色色的就业不平等现象。有关人士指出,就业歧视的现象不容忽视,尤其是我国入世后进行人才市场的规范时,应该引起高度重视,因为这与 WTO的一些基本原则有相抵触之处。
Article 3 of China's “Labor Law” stipulates that laborers have the right to equal employment and to choose their job. Article 12 stipulates that the employment of laborer shall not be discriminated against on the basis of ethnicity, gender ... Today, with the integration of the talent market in our country and the rest of the world, there are also varying degrees of employment inequality such as gender discrimination, appearance discrimination, age discrimination and so on. Concerned people pointed out that the phenomenon of employment discrimination can not be ignored, especially when China's accession to the WTO to regulate the market, we should attach great importance because it is in conflict with some of the basic principles of the WTO.
