陌生捐助是指民众通过网络平台对求助者进行的赠与,“罗一笑事件”是陌生捐助的典型案例。陌生捐助的动机包括同情心理、熟人互惠和其他因素,捐助人同时对受助人也有道德预设。“罗一笑事件”折射出一系列的社会问题,归根结底在于法律规则的缺失。制定或修改法律是解决陌生捐助问题的必然路径选择,可以采取的对策包括惩罚和保护两个方面——保护个人的求助权和捐助者的知情权及求偿权等,惩罚虚假求助者、诈捐者和非法网络捐助平台等,以及规范网络平台的管理。
