随着社会经济的迅猛增长和城市化建设进程的加快,城市拆迁房屋数量急剧增长,拆迁已经成为当时我国社会无法回避的话题。与此同时,因拆迁引发的家庭成员之间关于财产分割的矛盾纠纷不断升级,由此引发的民事纠纷大规模涌入法院。近5年北京市各级法院受理的因房屋征收、城市拆迁等案件呈高发态势。随着拆迁的安置、补偿带来的巨额经济补偿利益给家庭亲情以及以往约定俗成的乡规民约带来极大考验,亟待引起重视。当事人恶意诉讼层出不穷
