我国的现行立法规定了一套对地方政府规范性文件的监督审查机制,新修订的《立法法》与《行政诉讼法》对其进行了重要补充。该机制包含以人大、上级政府与法院为主体的三大审查制度。其中人大与上级政府皆采用备案审查的方式,但前者为外部监督,后者为内部自律。而法院只能附带于具体行政行为之诉进行审查。三大审查途径相互配合、衔接,共同组成了我国的地方政府规范性文件监督审查机制。
The current legislation in our country provides for a set of supervision and examination mechanisms for the normative documents of local governments. The newly revised “Legislation Law” and “Administrative Procedure Law” supplement them. The mechanism includes the three censorship systems with the NPC, superior government and courts as the main body. Among them, NPC and higher level governments all adopt the way of filing examination, but the former is external supervision and the latter is internal self-discipline. The court can only be included in the specific administrative action v. Review. The three reviewing channels cooperate with each other and join together to form the supervisory review mechanism of the regulatory documents of local governments in our country.
