当前,我省各个市、县正在进行行政机构改革和清理整顿执法单位的工作。这两件事,都涉及到市、县房地产管理部门在法律上该如何定位的问题,也就是说,市、县房地产管理部门是不是本行政区域房地产业的行业主管部门?具备不具备执法主体资格?对于这个问题的界定,我认为应该从四个方面来看,即:一、现行的法规和行政规章规定市、县房地产管理部门是本行政区房地产业的主管部门.我们查阅了国务院、建设部和省政府颁发的19个有关房地产行业单项管理的规章和8个政府文件,其中有18个单项的行业管理的法定主管部门是县以上地方人民政府房地产行政主管部门,有一个规章(房地产开发管理)规定,主管部门可以是建设部门,也可以是房地产管理部门;有一个规章(即外国人私有房屋管理)没有提主管部门,只提有关工作向当地房地产管理机关申报办理。
