徐先生等三人与张先生分别是同一住宅楼101、102、201、202室业主。2003年7月,张先生在对其购买的102室装修时,在进门防盗门内侧、沿底层楼梯下搭建木箱。底层原本属于全体业主的共同走廊,现在却成为张先生一户独用。因此物业管理公司以张先生擅自违章搭建为由,要求张先生限期整改拆除,恢复原样;而张先生则以搭建木箱处属闲置角落,并不影响进出通行为由不予拆除。许先生等人遂诉至法院,要求判令张先生停止侵害,恢复原状。法院审理后认为张先生在共用部位上擅自搭建,侵害了许先生等人的合法权益,故判决支
