信息技术的发展带来传播方式的变革,新闻作品的传播途径不断拓展,其传播方式也日趋多样化。传播途径和传播方式的变化使新媒体时代新闻作品侵权现象频发,新闻作品被侵权的方式更为隐蔽,引发了社会话题讨论。本文从著作权法角度对网络环境下新闻侵权行为进行剖析,并分析了新闻作品侵权行为的抗辩事由。同时站在媒体融合的行业发展角度,试图寻求传统新闻媒体和新媒体的合作共赢模式,在完善新闻作品版权保护的同时构建公平合理的利益共享机制。
The development of information technology has brought about the transformation of the mode of transmission. The way of dissemination of news works has been continuously expanded and its mode of transmission has also been increasingly diversified. Changes in the channels of transmission and modes of communication have caused frequent infringements on news works in the new media era and more subtle ways in which news works are infringed upon, triggering discussions on social topics. This article analyzes the news infringement under the network environment from the perspective of copyright law and analyzes the defenses of infringement of news works. At the same time, from the perspective of the development of the media convergence industry, trying to seek a win-win cooperation mode between the traditional news media and the new media, at the same time improving the copyright protection of the news work, at the same time, building a fair and reasonable interest-sharing mechanism.
