作为司法进步重要推动者,检察官职业群体承载着社会公众对法治理想的期望。但当前检察官职业群体由于内生动力不足,透漏出职业情绪耗竭、职业承诺降低等倾向,其发展前景不容乐观。内生动力问题归属于人本主义心理学范畴,本文借助马斯洛基本需求层次理论,尝试提出了“分离司法事务与行政事务”、“确立职业风险组织对抗机制”、“建立‘回应型’管理考核模式”、“回归法律人角色实质与形式”等思路,以期通过制度设计,追求检察官职业群体五层次需求满足的最大化,解决其内生动力不足问题,实现检察官职业群体发展之跃迁。
As an important promoter of judicial progress, the occupational group of procurators carries the public’s expectation of the ideal of law. However, due to the lack of endogenous motivation, the current prosecutors occupational groups are not optimistic about the development prospects due to the tendency of occupational exhaustion and lower occupational commitment. The problem of endogenous motivation belongs to the category of humanistic psychology. Based on Maslow’s basic hierarchy of needs, this paper tries to put forward the principles of “separation of judicial affairs and administrative affairs”, “establishment of professional risk organization confrontation mechanism” Establish the model of “response-based management assessment” and “return to the substance and form of legal person role”, in order to maximize the satisfaction of the five-level demands of the prosecutor’s occupational groups and to solve the problem of insufficient endogenous motivation through system design , To achieve the development of prosecutors career groups.
