新疆生产建设兵团是我国政治治理结构中承当着特殊政治和经济任务的一种组织和制度。从“隐秘的宪法”这种实际支配中国政治实践的“实效宪法”的立场看,新疆生产建设兵团制度具有宪法惯例的性质,并且其合宪性通过作为主权者代表的执政党的指示、命令和决定而得以进一步证成。新疆生产建设兵团的合法性的渊源在于其正当性,即源自于人民对生产建设兵团作为长期的政治实践传统、历史使命和任务的定位,以及实际效绩的普遍性认同。
