社会主义市场经济是法治经济。在市场经济体制下,企业经营管理须臾离不开法律的调整和规范。企业只有做到依法经营管理,才能成为真正的市场主体,才能建立规范有序的市场秩序。 我国已经正式加入世界贸易组织,企业已经完全置身于同国外企业按照同一规则进行平等竞争的空间。企业要在复杂激烈的市场竞争中赢得主动,必须在法律提供的空间内施展自己的经营战略。要避免市场风险,争取主动,必须对经营行为进行充分的法律论证。这是基础性的,也是必要条件。
