随着社会主义市场经济的发展 ,信用在经济中的地位日益重要 ,各地都十分重视建设社会信用体系、打造信用经济。本文以法治为视角 ,从诚信原则的法律化、信用立法、公正司法等三方面论述了信用经济和法治建设的关系 ,指出从道德观念到法律原则的转变是诚信被普遍遵守的重要前提、构造社会信用法律体系是建设信用经济的必要基础、公正司法是实现诚信原则法律约束力的根本手段 ,从而肯定了法治建设在当前建设社会信用体系、打造信用经济中具有重要地位。
With the development of the socialist market economy, credit has become increasingly important in the economy. All localities attach great importance to building a social credit system and building a credit economy. From the perspective of the rule of law, this paper discusses the relationship between the credit economy and the rule of law from three aspects: the legalization of credit principle, credit legislation and fair administration of justice. It points out that the change from moral concepts to legal principles is an important prerequisite for widespread adherence to honesty and credibility. The legal system of social credit is the necessary foundation for building a credit economy. Just administration of justice is the fundamental means to achieve the legal binding of the principle of good faith, which confirms that legal construction plays an important role in building a social credit system and building a credit economy.
