推进行政决策科学化、民主化、法治化是十八届四中全会提出的明确要求,十八届四中全会在总结我国多年行政决策实践的基础上,提出了一些新举措,如要求确定重大行政决策法定程序、积极推行政府法律顾问制度、建立重大决策终身责任追究制度及责任倒查机制。而2015年12月由中共中央和国务院联合印发的《法治政府建设实施纲要(2015-2020年)》在四中全会精神的基础上,提出了一些具体要求。本文根据十八届四中全会《决定》和《法治政府建设实施纲要(2015-2020年)》精神,从行政管理学的视角对“推进行政决策科学化、民主化、法治化”进行了深入分析,并提出了推进路径。
Promoting the scientific, democratization and rule of law of administrative decision-making is the explicit request put forward by the Fourth Plenary Session of the 18th CPC Central Committee. On the basis of summing up China’s many years of administrative decision-making practice, the Fourth Plenum of the 18th CPC Central Committee put forward some new measures, for example, Administrative decision-making statutory procedures, and actively promote the system of government legal advisers, the establishment of a major policy-making accountability system for life and the investigation mechanism of responsibility. In December 2015, the Outline for the Construction and Implementation of the Government by Law and Order (2015-2020) jointly issued by the CPC Central Committee and the State Council put forward some specific requirements based on the spirit of the Fourth Plenary Session. Based on the “Decision” of the Fourth Plenary Session of the 18th CPC Central Committee and the “Implementation Outline for the Construction of a Government by Law” (2015-2020), this essay conducts a “scientific and democratic administrative decision-making” on administrative policies from the perspective of administrative management In-depth analysis, and put forward the path to promote.
