现代化生产建设高速发展引起环境污染空前加剧,环境犯罪日益增多,使得传统的犯罪构成理论已不能适应当前的环境犯罪问题,因此要以科学发展观即以人为本,树立全面、协调、可持续发展来指导完善我国环境犯罪构成理论。本文从分析现状入手,通过存在的问题以及借鉴国外的先进理论经验对我国环境犯罪构成的主体、主观方面、客体、客观方面提出完善建议。
The rapid development of modern production and construction has led to the unprecedented increase of environmental pollution and the increase of environmental crime, which makes the traditional crime constitution theory unable to adapt to the current environmental crimes. Therefore, we should guide the scientific development concept that is people-oriented, establish a comprehensive, coordinated and sustainable development Perfecting China’s Constitution of Environmental Crime. Based on the analysis of the current situation, this paper puts forward some suggestions on the subject, subjective, objective and objective aspects of environmental crime in our country through the existing problems and the advanced experience of foreign countries.
