【裁判要旨】依据我国劳动法律的规定,乙肝病毒携带者依法享有公平就业权。用人单位在与劳动者缔结劳动合同的过程中,因歧视乙肝病毒携带者而不愿与之签订劳动合同,导致劳动者丧失就业机会,用人单位应承担缔约过失责任,该责任包括赔偿损失等形式。■案号一审:(2009)深南法民一(劳)初字第320号二审:(2010)深中法民六终字第1032号
[Referee motto] According to the provisions of our labor law, hepatitis B virus carriers have a fair employment rights according to law. In the process of concluding a labor contract with an employee, an employer is unwilling to sign a labor contract with the carrier because of discrimination against hepatitis B virus, resulting in loss of employment opportunities for the worker and the employer shall assume the liability of contracting for negligence, including compensation for damages . ■ Case No. First instance: (2009) Shennan Fumin a (labor) Chu Zi No. 320 Second instance: (2010) Shenzhongfa Min Liu Zi No. 1032
