20世纪70年代,在市场经济国家中,逐渐形成了一种市场化的节能投资机制——合同能源管理(Energy Performance Contract,简称EPC)。在我国,合同能源管理机制是舶来品。1992年~1994年,在世界银行(WB)和全球环境基金(GEF)的支持和帮助下,中国完成了《中国温室气体排放控制问题及战略研究》,我国从此尝试性的引进这一机制。作为一种新的机制,相关的法律制度的规制显得很有必要。各国针对合同能源管理机制都进行了不同程度的立法。本文着重介绍美国合同能源管理立法方面的现状,希望可以对于我国未来合同能源方面的立法予以启迪。
In the 1970s, a market-oriented energy-saving investment mechanism - Energy Performance Contract (EPC) - was gradually formed in market economy countries. In our country, the contract energy management mechanism is exotic. With the support and assistance of the World Bank and the Global Environment Facility (GEF) from 1992 to 1994, China completed the “Study on China’s Greenhouse Gas Emission Control and Its Strategic Studies”. Since then, China has introduced this mechanism tentatively. As a new mechanism, it is necessary to regulate the relevant legal system. Countries have different degrees of legislation on contract energy management mechanisms. This article focuses on the status quo of legislation on energy management in the United States and hopes that it can enlighten our legislation on future contractual energy sources.
