第一章总则第一条为促进建筑业的发展和建筑施工企业用工制度的改革,加强对外包工和临时工的安全管理,减少伤亡事故和职业危害,改善劳动生产条件,保障外包工和临时工在劳动过程中的安全和健康,特制定本办法。第二条外包工(发包工)系指在企业中,以提供劳务的形式分包工程项目或生产任务的人员(含独立承担分部、分项工程的建筑队);临时工系指根据劳动力使用计划临时使用,到期辞退的人员,包括从事季节性生产和服务工作的人员。第三条本办法适用于四川省行政区内从事建筑施工和生产的全民和城乡集体建筑企
