农村土地征用问题是城镇化过程中无法避免的问题。伴随着我国城镇化步伐的加快,土地征用现象发生的越来越多。土地是我国的稀缺资源,是农民得以生存的基础,也是维护农村稳定发展的前提。从我国目前的农村土地征用的程序来看,在土地征用过程中行政主体的自由裁量权过大过宽,这容易导致权力的滥用,在这种情况下公正的程序就显得尤为重要。
The issue of rural land acquisition is an unavoidable problem in urbanization. Accompanied by the acceleration of the pace of urbanization in our country, more and more land acquisition takes place. Land is a scarce resource in our country and the basis for the survival of peasants. It is also a prerequisite for safeguarding the stable development of the rural areas. Judging from the current procedures of rural land acquisition in our country, the administrative discretion in the process of land acquisition is too wide and too wide, which easily leads to the abuse of power.
