国家作为宏观调控主体,立足于全国范围内社会公众的整体利益——包括政治利益、经济利益、社会利益——制定宏观调控政策,然而作为“经济人”的地方政府,必然从主观和客观方面入手,采取各种手段加强落实宏观调控政策中有利于地方的政策,而对有利于公共利益的政策则淡然处之,这样的态度必将导致中央的政令不畅及“上有政策、下有对策”局面的出现。本文将从导致这种纵向利益冲突的原因入手进行分析,从法治和权责划分的角度提出相应的建议以期对这种利益冲突加以规范。
