2015年10月通过的《跨太平洋伙伴关系协定》(TPP)是美国主导的亚太区域自由贸易的新规则,该协定虽然随着特朗普的上台,该协议正式生效的可能性微乎其微,但是该协定在知识产权领域,在现有的国际规则的基础上提出了更高的要求,体现了未来知识产权领域的国际发展方向,值得我国进行思考和借鉴。本文以维基解密披露的TPP知识产权章节内容为基础,从保护范围、保护期限和保护水平三个方面全面介绍了TPP知识产权规定的基本内容及其对我国的影响。以TPP为代表的国际知识产权新规的出现对我国知识产权保护状况而言,一方面意味着更大的风险和挑战,另一方面也带来了启示和指导。
The Trans-Pacific Partnership (TPP), adopted in October 2015, is the new U.S.-led free trade rules in the Asia-Pacific region. Although it is unlikely that the agreement will come into force as Trump takes over, The agreement sets higher requirements on the basis of existing international rules in the field of intellectual property and reflects the international development direction in the field of intellectual property in the future and deserves our country’s thinking and reference. Based on the TPP intellectual property chapter disclosed by WikiLeaks, this article introduces the basic content of TPP IPR and its impact on China from three aspects: protection scope, duration of protection and level of protection. The emergence of the new international IPR represented by the TPP, on the one hand, means greater risks and challenges on the other hand, as well as enlightenment and guidance on the other hand.
